Privacy Policy and Cookies Policy for Replaio Services

1. Introduction

By providing Replaio Services, we do everything to ensure that using them is both pleasant and safe for you. When using our services, you entrust us with data related to using Replaio services. We assure you that we process data, including personal data, in a very limited scope and only what is necessary to provide our services at the highest level.

We respect and care about the privacy of our users. This is a key principle that guides us at Replaio. In this document, we want to present the rules we apply when processing personal data. We encourage you to carefully read our rules and practices.

We process personal data in accordance with the law, including the Regulation of the European Parliament and Council (EU) 2016/679 (GDPR) of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.

The controller of personal data processed as part of Replaio Services is Replaio spółka z ograniczoną odpowiedzialnością with headquarters in Krosno, ul. Tysiąclecia 14a, NIP 6842650730, REGON 381340090, entered into the National Court Register by the District Court in Rzeszów, XII Commercial Division of the National Court Register, under KRS number 0000749616.

The Privacy Policy used within Replaio Services is inseparably connected with the Terms of Use, which define the rules for using Replaio Services.

2. Information about the privacy policy

In our Privacy Policy, we want to provide you with information about the processing of personal data as part of providing Replaio Services, and we will also explain:

  • What data do we process?
  • For what purpose and on what basis do we process data?
  • What rights do you have?
  • How long do we store data?
  • Do we share data and where can it be processed?
  • From whom do we obtain personal data?
  • How do we protect the processed personal data?
  • What policy do we apply regarding children's privacy?
  • How do we use cookies or similar technologies?

3. What personal data do we process?

We process only the necessary data that you provide or leave while using Replaio Services and data from our partners. These are primarily data necessary to provide Replaio Services, including providing you with a Replaio account. You can use Replaio Services anonymously - without creating a Replaio account. However, this does not exclude the processing of personal data by us.

Providing some personal data is voluntary, but not providing it in the case of certain services will make it impossible to provide them.

You will find more information about what data we process in the next point in the "Purposes of data processing" section.

4. For what purpose and on what basis do we process personal data?

The basic purposes of our processing of personal data are:

  • providing Replaio Services available through the Replaio application, the Replaio website, and Replaio Search Console
  • fulfilling our legal or contractual obligations,
  • pursuing our legitimate interests.

When you start using our services, including by installing the Replaio Radio application or visiting our websites or internet services, you accept and enter into an agreement with us in accordance with our Terms of Use. Under this agreement, we are obligated to provide you with services, which requires the processing of personal data.

4.1. Purposes of data processing

4.1.1. Providing and personalizing Replaio Services

In order to provide services for users who do not use the login option (without a Replaio Account), we process data regarding the user's device, the device's IP address, information contained in cookies or other similar technologies, and session data.

To offer Replaio Services tailored to the user's location (e.g., suggesting local radio stations), it is necessary to process location data. For the purpose of providing Replaio services, we process the user's device IP address. This simplified "geolocation," i.e., assignment to the place of service provision, is based solely on the IP address. From the information obtained in this way, it is not possible to obtain precise information about the user's actual location.

When providing services for users using an account in Replaio services, we additionally process:

  • information necessary for account registration: email address and password,
  • information provided to identify the account: identifier (nickname), first name, last name,
  • information necessary for logging in through other services: Facebook, Google, Huawei: email address, first name, last name, avatar,
  • in the case of additional, paid options available in Replaio Services - information about making a payment.

Using an account in Replaio services requires providing authentication data: email address and password.

In the case of the Replaio application, providing first and last name is voluntary, and the user can add it at any time independently as data identifying the account.

We process this data for the purpose of providing services, i.e., performing the contract. The legal basis for collecting and processing personal data is Art. 6(1)(b) GDPR.

4.1.2. Communication

When contacting our users as part of technical assistance and instructions on how to use the application, as well as collecting opinions about the application, we process the email address and message content.

We process this data for the purpose of providing services, i.e., performing the contract and in the legitimate interest, which consists of ensuring contact with users. The legal basis for collecting and processing personal data is Art. 6(1)(b) and Art. 6(1)(f) GDPR.

4.1.3. Newsletter

For users who have voluntarily registered for the Newsletter service, we provide the service of delivering messages with information related to Replaio Services. For this purpose, we process the email address provided by the user during registration.

We process email addresses provided for this purpose in order to perform the contract in accordance with Art. 6(1)(b) GDPR.

As part of the Newsletter service, we may send users marketing content consisting of promoting Replaio services and products as well as those of our partners. In this case, we process personal data on the basis of legitimate interest in accordance with Art. 6(1)(f) GDPR.

We may also process the email address used as part of the Newsletter service for the purpose of possible establishment, pursuit, or defense against claims. The legal basis for processing is our legitimate interest - Art. 6(1)(f) GDPR consisting of protecting our rights.

4.1.4. Diagnostics, problem solving, development, developing new features and improvements to Replaio Services

In order to improve the quality of our services, we may process information regarding the use of Replaio Services, including information about the session, IP address, time spent using Replaio Services on individual screens, pages and subpages, use of features and content.

We process this data for the purpose of providing services, i.e., performing the contract and in the legitimate interest, which consists of creating solutions that facilitate the use of services and improve the quality and functionality of the services provided. The legal basis for collecting and processing personal data is Art. 6(1)(b) and Art. 6(1)(f) GDPR.

4.1.5. Statistics

For the purposes of statistical analyses regarding the use of services, Replaio uses the services of Google Ireland Limited: Google Analytics and Google Firebase, a service provided by:

Google collects and processes data that enable analysis of how users use Replaio Services. The data obtained in this way are not linked in any way to other personal data processed by Google. Replaio has no influence on the scope of such data collection. The legal basis for data processing is Art. 6(1)(f) GDPR.

4.1.6. Marketing, promotion, and advertising

Direct marketing

We do not use personal data, including email addresses and other data concerning users' identity, for marketing purposes of other entities. However, we may occasionally send information regarding our promotional activities in the form of email messages or push notifications directly in the application.

To partially cover maintenance costs, we place advertisements in our services provided by our partners. To deliver advertisements and content more tailored to users' interests, our partners may use advertising identifiers or similar technologies.

Interest-based personalized advertising

Profiling for marketing purposes is carried out by our trusted partners. It takes place provided that you consent to it. Consent is voluntary. Consent may be expressed in a message displayed during the consent collection process. You can withdraw your consent at any time.

Delivering advertisements tailored to users' interests is done using unique identifiers.

We do not combine this information with information identifying users. Our partners whose services we use are:

Replaio uses Google's services to display advertisements in Replaio Services (text ads, banners, etc.). Cookies or other solutions used by Google, or a third party on behalf of which Google acts, e.g., advertising identifier, may be stored on the user's device. Through them, Google obtains data about users' interests based on the websites they visit or applications they use. Google uses the information obtained in this way to analyze user behavior in relation to advertisements. If necessary, Google also transfers this data to third parties if the third party processes data at Google's request. Google does not link the user's IP address with other data. Replaio has no influence on the processing of personal data by Google.

You can block the installation of cookies or the use of similar technologies using settings on your mobile device. You can also limit the collection of data related to the use of applications by Google by changing the ad display settings. Through Google services, Replaio displays advertisements from various advertising networks. The selection and display of advertisements are completely automatic. As part of this process, the following are processed: IP addresses, cookie file identifiers, unique identifiers, as well as the time the advertisement is displayed and the time the advertisement is clicked.

Ads delivered by Google are displayed based on activity and how Google services are used. Among other things, the information you add to your Google account, interests estimated based on your internet activity, and interactions with advertisers who work with Google to display ads are analyzed. b) Facebook

Replaio uses services provided by Facebook to display advertisements in Replaio (text ads, banners, etc.). For this purpose, Replaio sends pseudonymized data to Facebook along with information that the application has been launched. The advertising identifier provided by the device's operating system is used. Replaio has no influence on the data processing by Facebook Inc. The purpose and scope of the collection, processing, and use of data by Facebook Inc., as well as rights and configuration options to protect privacy, can be found in the privacy policy at: https://www.facebook.com/policy.

Ads delivered by Facebook are displayed based on your activities and use of Facebook services. Among other things, pages liked by you and your friends, information from your Facebook and Instagram profile, places where you check in on Facebook are analyzed. We process this data in the legitimate interest, which consists of obtaining the means necessary to finance the services provided. The legal basis for collecting and processing your personal data is Art. 6(1)(f) GDPR.

4.1.7. Investigations, pursuit of claims

In the case of proceedings related to violations of the Terms of Use or legal provisions, proceedings to pursue our claims, defense against claims of users or other entities, we may process the personal data of specific users.

If personal data will be processed for the purpose of pursuing claims of other users, this data may be made available to other users and entities or public authorities authorized under the law, e.g., courts, police, prosecutor's office.

We will then process this data, including make it available, for the purpose of fulfilling an obligation arising from legal provisions, i.e., in the legitimate interest consisting of pursuing our claims against the user. 4.1.8. Ensuring compliance with the law

We may process personal data for the purpose of fulfilling legal obligations related to the activities and requests of law enforcement authorities. The legal basis for such processing of personal data is compliance with applicable law and legitimate interest. The legal basis for collecting and processing your personal data is Art. 6(1)(c) and Art. 6(1)(f) GDPR.

4.1.9. Social media

Facebook

As part of maintaining profiles in social media, e.g., Facebook, we may have access to anonymized data of Facebook users who visit and are active on the Replaio fanpage. The legal basis for processing such data is our legitimate interest based on Art. 6(1)(f) GDPR, consisting of promoting our own brand.

When using the Facebook service provided by Meta Ireland, Replaio acts as a joint controller of data regarding how users use the Replaio fanpage. More information about this type of data processing can be found at: https://www.facebook.com/legal/terms/page_controller_addendum.

4.1.10. Other services

As part of the option to create a playlist of favorite tracks in Spotify available from the Replaio Radio application, we may process data necessary for the integration of Replaio with the user's Spotify account. For this purpose, we may process the user's identifier in the Spotify service. We process this data for the purpose of performing the contract in accordance with Art. 6(1)(b) GDPR.

5. What rights do you have?

The General Data Protection Regulation GDPR grants natural persons specific rights regarding their personal data. Replaio provides users of its services with the possibility to exercise these rights, subject to technical possibilities and limitations resulting from applicable law.

When using Replaio services, you have the following rights regarding the processing of your personal data:

Right of access to data

You have the right to be informed about personal data that we process and you can request access to this data.

Right to rectification and completion of data

You can rectify your personal data. If you obtain information that your personal data processed by us is incorrect, outdated, or incomplete, you have the right to request its immediate rectification or completion.

Right to erasure of data

You have the right to request the erasure of some of your personal data.

A user who has created a Replaio account can send a request to delete it at any time.

  2. Go to the Menu and select Account.
  3. Click the more icon (three dots) and select the Delete account option.

  2. Click "Log in" and log in to your Replaio account.
  3. Select the "Delete account" option and confirm the deletion of your Replaio account.

Right to restriction of processing

You have the right to temporarily or permanently cease the processing of all or some of your personal data.

Right to object

You can object to the processing of your personal data by us at any time.

Right to data portability

You have the right to data portability - the right to request a copy of your personal data in electronic form and the right to transfer it to another entity for the purpose of providing services by that entity. To exercise the above-mentioned rights, please contact us at the email address provided in the introduction to this privacy policy.

Right to lodge a complaint with a supervisory authority

You have the right to lodge a complaint with a supervisory authority dealing with personal data protection.

6. How long do we store personal data?

We store personal data as long as it is necessary for the purpose of:

  • providing services at the highest level,
  • legitimate business interest related to the development and improvement of provided services,
  • ensuring compliance with legal obligations,
  • resolving claims and disputes.

Most data we store only for the period of your use of Replaio Services.

Personal data recorded during the provision of Replaio Services will be deleted if they are no longer needed to fulfill the purpose related to storage.

Personal data of Replaio users will be deleted after withdrawal of consent for such processing and storage, where applicable.

Deletion does not include data whose correction, blocking, or deletion is contrary to statutory or contractual retention periods, as well as data necessary for the establishment, implementation, or modification of the contractual relationship between Replaio and the user.

7. Do we share data and where can it be processed?

We do not transfer personal data outside the EU or EEA unless it is necessary. However, some of our partners and service providers may have their headquarters or their servers may be located in another country. Any operations related to such transfer of personal data take place exclusively in accordance with the regulations governing the processing of personal data, in particular the GDPR. We ensure that third-party recipients use standard contractual clauses compliant with EU law.

Service providers we cooperate with in providing Replaio services

In order to provide Replaio services at the highest level and in accordance with the law, we may transfer certain data to other trusted entities cooperating with us:

  • hosting service providers providing us with certified and secure IT resources,
  • internet and analytical service providers.

Data transfer to service providers takes place exclusively on the basis of appropriate cooperation agreements, which are consistent with personal data processing regulations, in particular with the GDPR.

Any transfer of data by DigitalOcean to a country outside the EU or EEA, which may be necessary for the provision of services, is based on data protection guarantees in accordance with the GDPR, in particular as part of data transfer agreements containing standard contractual clauses approved by the European Commission.

Freshworks Inc. provides, among other things, the Freshdesk service, which we use as part of providing Replaio Services to handle contacts with our users in order to provide technical assistance and support regarding the use of the application. Freshworks processes personal data in the USA and EEA as well as in other countries through third parties whose services it uses. Other entities

Apart from the cases described above, we do not disclose or transfer personal data to other users and entities. However, under applicable law, we may in certain situations be required to disclose personal data, e.g., to law enforcement authorities, state authorities, or other users for the purpose of pursuing their claims. In such cases, only the data that we are obliged to disclose will be transferred.

8. From whom do we obtain personal data?

In order to provide Replaio Services, we may obtain personal data from other trusted and lawfully operating external partners.

8.1. Partners providing authentication services

When creating a Replaio account, you can choose the option to log in using your account in one of the services: Facebook, Google, Huawei. In that case, partners provide us with the necessary data that help us create your account. This is done on the basis of secure APIs provided by our partners.

In the next step, you will be redirected to the Huawei service, where you can log in using your authentication data. After successful login, the Huawei service provides Replaio with basic user data stored on your Huawei profile. This is data that is publicly available and made available to third-party services with your consent. Replaio may process your first and last name, email address, and profile picture. This information is necessary to identify you when using a Replaio account.

8.2. Partners providing technical services

We use the services of partners who provide us with IP address mapping service. In this way, we determine the approximate location of users. We determine the location only at the country level. This is necessary to provide Replaio Services and ensure appropriate features and content tailored to the user.

9. How do we protect personal data?

We respect the personal data of our users and strive to provide them with protection at the highest level. We act in accordance with applicable law and apply reasonable administrative, logical, physical safeguards to protect personal data against loss, theft, unauthorized access, use, or modification. These safeguards are designed to provide a level of security appropriate to the risks associated with processing the personal data of our users. We have implemented and apply various data protection policies, including pseudonymization, data encryption, access control, and data is stored in certified secure Data Centers.

10. Protection of children's privacy. Do we collect data from children?

Our Services are not directed at children under the age of 13, and we knowingly do not collect information about them. If we determine that a person under the age of 13 has provided us with their personal data, we will immediately delete it.

If you have information that a child under the age of 13 or a child over the age of 13 without parental consent has provided us with personal data, please contact us. If we learn that we have collected any personal data from children that we should not process, or for which parents have not given consent, we will immediately take steps to delete such data.

11. Cookie policy (including similar technologies)

Replaio websites and Services including Replaio, Replaio Search Console, Replaio Radio application may use technical capabilities provided by internet markers, such as cookie files or similar technologies, including unique identifiers. In the further part of the document, we will refer to all these solutions as "cookies".

Cookies, which may be saved on a computer, smartphone, or tablet when visiting websites and internet services, are used to collect and store information about users' activities. Thanks to this, user preferences can be used to display more relevant search results, deliver expected content, or display advertisements and promotional offers tailored to the user's interests.

Cookies usually contain the domain name of the website they come from, a unique identifier, and the time they are stored on the device.

For what purpose do we use cookies?

  1. On the repla.io and blog.repla.io websites in Replaio Services, we use cookies or similar technologies for the following purposes. Providing services, including maintaining user session after login, so that users do not have to re-enter their login and password on each subpage.

  2. Optimization, so that our services and websites work faster and are easier to use.

  3. Analyses and statistics, which allow us to understand how users use our services and websites. This allows us to develop and adapt our services to users' expectations and needs.

  4. Facilitating the presentation of advertisements tailored to users' interests.

What types of cookies do we use?

  1. Necessary cookies - ensure the proper functioning of websites and their basic functions. Without them, users would not be able to properly use the services available on websites.

  2. Analytical cookies - our websites use cookies provided by Google Analytics. Analytical cookies enable tracking the number and sources of visits, allowing us to measure and improve the performance of our services. This type of cookies helps us understand which subpages are most or least frequently visited and how visitors use our services. We also work with external partners who provide us with analytical tools, e.g., Google Analytics. Google in this case uses its own cookies.   3. Marketing cookies - our services use the possibilities offered by third-party cookies in terms of targeting and displaying advertisements and promotional offers. This allows us to partially finance the development of our services by displaying advertising banners, video ads, and promotional offers well tailored to users' interests and internet activities. In this case, we use the services of external advertising service providers, including Google. Consent management and legal compliance

To provide our users with transparency and control over the processing of personal data, we apply practices consistent with IAB Europe standards.
