On the matter of reporting abuse in confession, we are likely to read a great deal more about that when the CA Royal Commission publishes its report. It's an important area.  Sadly we do not know the name of the solicitor from Hugh James, and neither could we easily get it from either the firm or its website.  

IICSA 13/12/17 - Dom Richard Yeo - No legal obligation for schools to report abuse to statutory authorities but Church policies indicate schools 'should.' 13.12.2017

Yeo's reply deceives. Neither statutory guidance nor Church policies demand child abuse 'must' be reported to the statutory authorities. 'Should' is discretionary - with little accountability if one doesn't report. Dom​ ​Richard​ ​Yeo was Abbot of Downside between 1998-2006

IICSA 12/12/17 - Dom Richard Yeo is asked about F65 who is alleged to have kissed a boy of 16 yrs and performed fellatio on him. F65 thereafter became a Governor, and F77 a Trustee. 12.12.2017

Former Abbot Ampleforth 1998-2006. His reply to a question from Karmy-Jones is short.

Headmaster of Downside 2003-2014. From 2014 to present - Prior Administrator. A script writer would be dissed for this story line.

IICSA 6/12/17: Jane​ ​Dziadulewicz Clifton Diocese Safeguarding - Recommending the principle of #Mandatory Reporting for the catholic church 07.12.2017

Responsibility and accountability are missing from safeguarding presently. Being utterly realistic Ms Dziadulewicz suggests law is needed. She is correct. The decades long misapplication of research from familial abuse to the complex structures of Regulated Settings has got to stop. It's failed staff, children and their parents.

Many times Mandate Now has said reporting abuse is 'discretionary.' We have also written many times there is nominal responsibility and no accountability. This extract from the evidence of ​Ms Dziadulewicz says much the same.

A key shortcoming in Regulated Activity safeguarding and child protection. Safeguarding is 'discretionary.' It's a safety critical function - yet discretionary.

IICSA 6/12/17 - Following her courageous testimony today, Witness RC-A117 was asked if she had anything further to add. Yes she did. 06.12.2017

Witness RC-A117 wants mandatory safeguarding. Her solicitor Richard Scorer later confirmed she meant mandatory reporting of known and suspected abuse. MR is becoming a theme in the catholic investigation.

IICSA 1/12/17 - David Molesworth North Yorks CC asked about secret letter he saw for the first time 6 days ago from Ampleforth lawyers to Abbot Cuthbert Madden 01.12.2017

Karmy-Jones QC at 05.18" asks Molesworth if he would like to add anything to his evidence to assist the panel. MN recognises most of it - Local Authorities have almost no authority over independent schools. Lack of effective oversight appears, and he gets terribly close to alluding to Mandatory Reporting. Shame he didn't say it. Cuthbert Madden became Abbot of Ampleforth in 2005.

Surprisingly it's not quite anyone's fault - it seems. But the people who will pay the price are the CP abusees in the inquiry, and child protection in future.

In the report Ecclesiastical Insurance is heavily criticised for its inconsistent advice to CofE and it has often acted with little concern for survivors of clergy abuse.

Dr Christine Barter is a researcher at UCLAN. The programme was about child/child abuse Talking values and the introduction of 'better training' alone, will not change the inconsistency Dr Barter talks of. Reports can easily be mandated which will introduce support and clarity for staff, as well as consistency. Expertise will be introduced to address the challenge schools face in this realm.
